(AP) ? Sidney Crosby has been hit in the mouth by a puck and the Pittsburgh Penguins' star captain will not return to the game against the New York Islanders.

A bloodied Crosby skated off the ice with a towel covering his mouth after Brooks Orpik's slap shot from the point deflected off a stick and hit the NHL scoring leader just 1:28 into Saturday's game.

Crosby, who immediately fell to the ice and tossed his stick in the air, did not return in the first period. Early in the second, the Penguins announced that he would not be back in the game.

Crosby has a history of concussions that have kept him out for long periods during his stellar career.

Pittsburgh was looking for its 15th straight victory, which would be two shy of the NHL record set by Mario Lemieux and the 1992-93 Penguins.

With 15 goals and 56 points, Crosby held a 10-point lead over Tampa Bay's Steven Stamkos in the NHL scoring race.

India's top court to deliver Novartis judgment

(AP) ? India's Supreme Court is to rule Monday on a landmark patent case involving Swiss drugmaker Novartis AG that focuses on demands by major companies that their investments be protected, against Indian companies that say they should be allowed to continue producing cheaper generic versions of many lifesaving medicines.

A decision in the seven-year legal battle is keenly awaited by the two most interested parties? big pharma companies and health aid groups ? with both sides saying the outcome will set a precedent with far-reaching consequences for the future availability of the drugs.

"Across the world, people rely on India for supplies of affordable versions of expensive patented medicines," said Leena Menghaney of Doctors Without Borders. "This case will have fundamental consequences."

The case goes back to 2006 when Novartis' application for a fresh patent in India for its cancer drug imatinib mesylate was rejected by the Indian patent office.

The patent authority cited a legal provision in India's 2005 patent law aimed at preventing companies from getting fresh patents for making only minor changes to existing medicines ? a practice known as "evergreening."

The drugmaker has argued that its leukemia drug Gleevec, known in Europe and India as Glivec, was a newer, more easily absorbed version that qualified for a fresh patent.

The company filed an appeal, but India's patent appeals office turned it down in 2009 on the grounds the company was unable to show significant increase in efficacy of the drug.

Novartis then approached the Supreme Court in August 2009, which heard arguments seeking to challenge the interpretation and application of India's patent law in the case.

Gleevec, used in treating chronic myeloid leukemia and some other cancers, costs a patient about $2,600 a month. Its generic version was available in India for around $175 per month.

"The difference in price was huge. The generic version makes it affordable to so many more poor people, not just in India, but across the world," said Y.K. Sapru, of the Mumbai-based Cancer Patients Aid Association.

The case once again pits big pharmaceutical companies against health activists and aid groups with both sections arguing that the judgment would be an important milestone for the future of the pharmaceutical industry worldwide.

"The Novartis verdict is important because it will determine whether India gets to limit patents to genuine new drugs, or whether drug companies get to "evergreen" their patents until eternity, simply by re-patenting a slightly modified version of a known substance," said Ellen 't Hoen, a pharmaceutical law and policy consultant.

Western pharmaceutical companies have warned that a rejection of Novartis' application would discourage investment in research and innovation, and would hobble drugmakers' efforts to refine and improve their products.

The international drug majors have been pushing for stronger patent protection in India to regulate the country's $26 billion generic drug industry, which they say often flouts intellectual property rights.

In a statement sent to The Associated Press late last year, Novartis said patent protection was important to ensure effective protection for innovation.

"Knowing we can rely on patents in India benefits government, industry and patients because research-based organizations will know if investing in the development of better medicines for India is a viable long-term option," the company said.

Groups such as Doctors Without Borders say cheaply made Indian generics are a lifesaver for millions of patients in poor countries who cannot afford to pay Western prices to treat diseases such as cancer, malaria and HIV.

India, which has emerged as the world's pharmacy for the poor, has come under intense scrutiny from pharmaceutical giants who say India's 2005 Patent Act fails to guarantee the rights of investors who finance drug research and development.

The country's recent decision to allow a local manufacturer to produce a generic version of Bayer's patented cancer drug Nexavar, to make the drug available to the public at a reasonably affordable price, has also not gone down well with Western pharmaceutical companies.

Health and aid groups were clearly nervous before the top court rules on the Novartis case.

"Generic companies depend on the freedom to operate. If there are too many intellectual property-related challenges, then the companies very quickly withdraw from making that drug," said Menghaney.

The groups fear that a ruling in favor of Novartis would lead to a proliferation of patents ? some based on a minor tweaking of formulation and dosages ?on dozens of other generic medicines that Indian companies have been producing and supplying to needy nations at far lower costs than those charged by Western drug manufacturers.

And the fallout of the judgment will be felt across the world, says Menghaney. "It's not just about India."

"If generic competition on many crucial medicines ends, then prices for these medicines will increase, both in India and across the developing world. This would be devastating for millions who rely on India for affordable medicines."

New York City appeals ?soda ban? ruling

NEW YORK?City officials are asking an appeals court judge to reinstate a ban on the sale of large sugary drinks, arguing it is crucial to stopping a ?serious health crisis? linked to obesity.

The ban, championed by New York City Mayor Michael Bloomberg, was struck down March 11?less than 24 hours before it was set to take effect?by state Supreme Court Justice Milton Tingling, who argued that the new regulation was undermined by loopholes. Tingling noted, among other things, an exemption that would have allowed state-regulated stores like 7-11 to continue selling large sodas.

Tingling also argued that Bloomberg and the city?s Board of Health had overstepped their authority by not first putting the ban to a vote in the New York City Council.

But Michael Cardozo, an attorney for the Bloomberg administration, rejected those points in the appeal the city filed Monday. Echoing arguments that have been made by Bloomberg in recent weeks, Cardozo said the Health department has a long track record of implementing ?substantive rules and standards? aimed at protecting the health of city residents. Among other things, he cited a city requirement that fast food restaurants post the calorie counts of their menu items as well as municipal restrictions on the use of lead paint.

Under the law, the so-called "soda ban" would have limited the sale of sugary drinks to just 16 ounces per serving at establishments regulated by the city, including bars, restaurants, bodegas and movie theaters. But there were several exceptions to the rule, including sweetened drinks that were more than 50 percent milk. Ahead of the ban?s implementation, Starbucks said it would not comply amid confusion about how the law would be enforced.

Responding to Tingling?s criticism that the ban was riddled with loopholes, Cardozo argued in the appeal that the law is less about a sweeping ban and more about trying to encourage residents to make better choices about their diet?another point that has been emphasized by Bloomberg in recent weeks.

"The rule is designed to make consumption of large amounts of sugary drinks a conscious and informed choice by the consumer," the city?s appeal read. "Thus, although a consumer is free to consume more than 16 ounces by ordering a second drink, getting a refill, or going to another store, he or she will be making an informed choice."

HIV Test Urged for 7K Dental Patients

Health officials are urging 7,000 patients of an Oklahoma dentist to seek medical tests to ensure they haven't been exposed to hepatitis or the virus that causes AIDS.

The Oklahoma and Tulsa health departments said Thursday that the patients may have been exposed to viruses at clinics operated by Dr. W. Scott Harrington. The agencies said they found "major violations" of the Oklahoma Dental Act.

Spokeswoman Kaitlin Snider of the Tulsa Health Department says Harrington voluntarily closed his practice and is cooperating with investigators.

Letters are being sent to 7,000 patients from Harrington's clinics in Tulsa and suburban Owasso since 2007. The letters recommend testing for hepatitis B, hepatitis C and HIV. The agencies say it is rare for infections to spread in occupational settings but that tests are important.

    Symptom #1: Pelvic Pain

    Chronic pelvic pain can indicate benign uterine fibroids, endometriosis or pelvic inflammatory disease.

    ?Fortunately, most pelvic discomfort isn?t related to ovarian cancer, but women should know the disease?s unremitting constellation of symptoms,? Holly Puritz, MD, FACOG, an obstetrician and gynecologist told WebMD.

    The constellation of symptoms can include abdominal pain or discomfort, bloating and cramps nausea, diarrhea, abdominal swelling, constipation, or sudden unexplained weight change.

    ?If you have two weeks of bloating, pelvic pressure, and frequent urination -- and every day, you have it -- that?s a potential sign you should be checked for possible symptoms of ovarian cancer,? said Puritz in WebMD.

    Symptom #2: Irregular Vaginal Bleeding

    Irregular vaginal bleeding could come from multiple causes that aren?t serious including perimenopause, uterine fibroids or polyps, reported WebMD.

    For bleeding after sex, Redbook.com wrote that an unlikely culprit could be chlamydia, a sexually transmitted infection. The least common scenario would be cervical cancer.

    One common cause for spotting between periods is not taking oral contraceptives at the same time every day. Less likely culprits are uterine fibroids. And the least common scenario is endometrial cancer, which frequently causes irregular vaginal bleeding in premenopausal women, wrote Redbook.com.

    Symptom #3: Abnormal Vaginal Discharge

    Abnormal vaginal discharge may signify an easily treatable infection, said HealthCentral.com. This includes a yeast infection, bacterial vaginosis or trichomoniasis. MDAnderson.org warned that vaginal discharge colored with blood is sometimes a sign of cervical or endometrial cancer.

    Symptom #4: Persistent Itch

    Redbook.com wrote that the most common cause is a yeast infection.

    Large robotic jellyfish could one day patrol oceans

    Mar. 28, 2013 ? Virginia Tech College of Engineering researchers have unveiled a life-like, autonomous robotic jellyfish the size and weight of a grown man, 5 foot 7 inches in length and weighing 170 pounds.

    The prototype robot, nicknamed Cyro, is a larger model of a robotic jellyfish the same team -- headed by Shashank Priya of Blacksburg, Va., and professor of mechanical engineering at Virginia Tech -- unveiled in 2012. The earlier robot, dubbed RoboJelly, is roughly the size of a man's hand, and typical of jellyfish found along beaches.

    "A larger vehicle will allow for more payload, longer duration and longer range of operation," said Alex Villanueva of St-Jacques, New-Brunswick, Canada, and a doctoral student in mechanical engineering working under Priya. "Biological and engineering results show that larger vehicles have a lower cost of transport, which is a metric used to determine how much energy is spent for traveling."

    Both robots are part of a multi-university, nationwide $5 million project funded by U.S. Naval Undersea Warfare Center and the Office of Naval Research. The goal is to place self-powering, autonomous machines in waters for the purposes of surveillance and monitoring the environment, in addition to other uses such as studying aquatic life, mapping ocean floors, and monitoring ocean currents.

    Jellyfish are attractive candidates to mimic because of their ability to consume little energy owing to a lower metabolic rate than other marine species. Additionally, they appear in wide variety of sizes, shapes and colors, allowing for several designs. They also inhabit every major oceanic area of the world and are capable of withstanding a wide range of temperatures in both fresh and salt waters. Most species are found in shallow coastal waters, but some have been found in depths 7,000 meters below sea level.

    Partner universities in the project are Providence College in Rhode Island, the University of California Los Angeles, the University of Texas at Dallas, and Stanford University. Priya's team is building the jellyfish body models, integrating fluid mechanics and developing control systems.

    Cyro is modeled and named after the jellyfish cyanea capillata, Latin for Llion's Manemain jellyfishJellyfish, with "Cyro" derived from "cyanea" and "robot." As with its predecessor, this robot is in the prototype stage, years away from use in waters. A new prototype model already is under construction at Virginia Tech's Durham Hall, where Priya's Center for Energy Harvesting Materials and Systems is based.

    "We hope to improve on this robot and reduce power consumption and improve swimming performance as well as better mimic the morphology of the natural jellyfish," Villanueva said, adding that the project also allows researchers such as himself to better understand aquatic creatures live. "Our hopes for Cyro's future is that it will help understand how the propulsion mechanism of such animal scales with size."

    A stark difference exists between the larger and smaller robots. Cyro is powered by a rechargeable nickel metal hydride battery, whereas the smaller models were tethered, Priya said. Experiments have also been conducted on powering jellyfish with hydrogen but there is still much research to be done in that area.

    In both cases, the jellyfish must operate on their own for months or longer at a time as engineers likely won't be able to capture and repair the robots, or replace power sources. "Cyro showed its ability to swim autonomously while maintaining a similar physical appearance and kinematics as the natural species," Priya said, adding that the robot is simultaneously able to collect, store, analyze, and communicate sensory data. This autonomous operation in shallow water conditions is already a big step towards demonstrating the use of these creatures."

    How does the robot swim? Its body consists of a rigid support structure with direct current electric motors which control the mechanical arms that are used in conjunction with an artificial mesoglea, or jelly-based pulp of the fish's body, creating hydrodynamic movement.

    With no central nervous system, jellyfish instead use a diffused nerve net to control movement and can complete complex functions. A parallel study on a bio-inspired control system is in progress which will eventually replace the current simplified controller. As with the smaller models, Cyro's skin is composed of a thick layer of silicone, squishy in one's hand. It mimics the sleek jellyfish skin and is placed over a bowl-shaped device containing the electronic guts of the robot. When moving, the skin floats and moves with the robot, looking weirdly alive.

    "It has been a great experience to finally realize the biomimetic and bio-inspired robotic vehicles," Priya said. "Nature has too many secrets and we were able to find some of them but many still remain. We hope to find a mechanism to continue on this journey and resolve the remaining puzzles."

    How diabetes drug delays aging in worms

    Mar. 28, 2013 ? A widely prescribed type 2 diabetes drug slows down the aging process by mimicking the effects of dieting, according to a study published today using worms to investigate how the drug works.

    Following a calorie-restricted diet has been shown to improve health in later life and extend lifespan in a number of animals, ranging from the simple worm to rhesus monkeys. The type 2 diabetes drug metformin has been found to have similar effects in animals but until now it was not clear exactly how the drug delays the aging process.

    Researchers supported by the Wellcome Trust and Medical Research Council looked at the effects of metformin on C. elegans worms that were grown in the presence of E. coli bacteria, a relationship similar to that which humans have with the 'healthy' bacteria in our gut. They found that the worms treated with metformin lived longer only when the E. coli strain they were cultured with was sensitive to the drug.

    Dr Filipe Cabreiro from the Institute of Healthy aging at UCL, who led the research, explains: "Overall, treatment with metformin adds up to 6 days of life for the worm which is equivalent to around a third of its normal lifespan. It seems to work by altering metabolism in the bacteria that live in the worm, which in turn limits the nutrients that are available to the worm host and has a similar effect to restricting the diet."

    Bacteria living in the gut have an important role in helping the host organism to digest and extract nutrition from food. Defects in gut bacteria have been linked to metabolic diseases such as obesity, diabetes, inflammatory bowel disease and cancer. It has also been suggested that gut bacteria may have an impact on the aging process, but this is the first study to suggest a mechanism for how this works.

    The team used strains of E. coli with defects in genes that are linked to metabolism and tweaked the levels of nutrients available to tease out which metabolic pathways might be affected by the drug. They found that treatment with metformin disrupted the bacteria's ability to metabolise folate, a type of B-vitamin, and methionine, one of the building blocks of proteins. This limits the nutrients that are available to the worm and mimics the effects of dietary restriction to enable the worms to live longer.

    However, when they added an excess of sugar to the diet, the team found that the life-extending effects of metformin were cancelled out. As the drug is used as a treatment for diabetes caused by elevated glucose levels in the blood, this finding is particular relevant for understanding how the drug works in people.

    Professor David Gems, who directed the study, said: "We don't know from this study whether metformin has any effect on human aging. The more interesting finding is the suggestion that drugs that alter bacteria in the gut could give us a new way of treating or preventing metabolic diseases like obesity and diabetes."

    Metformin is currently one of the most widely prescribed drugs and the findings should help to inform how it is used in patients.

    Cyprus controls expected to hit foreign transactions

    NICOSIA (Reuters) - Cyprus is expected to stop people taking their money out of the country but will not restrict dealings at home as it tries to avert a run on its banks after agreeing a tough rescue package with international lenders.

    Cypriots have taken to the streets of Nicosia in their thousands to protest against a bailout deal that will push their country into an economic slump and cost many their jobs.

    European leaders said the deal averted a chaotic national bankruptcy that might have forced Cyprus out of the euro.

    With banks due to reopen on Thursday after nearly two weeks, Finance Minister Michael Sarris said capital controls will be "within the realms of reason" and a business leader said he had been told they would affect only international transactions.

    "We will look at the best way to limit the possibility of large sums of money leaving, and not imposing punitive conditions on the economy, businesses and individuals," Sarris told local television.

    Speaking after meeting government officials, the head of the Cyprus chamber of commerce said: "We have been assured that limitations will not affect transactions within Cyprus at all."

    "Where there will be limitations is on what we spend abroad and also on capital outflows," Phidias Pelides told reporters.

    The central bank governor said earlier that "loose" controls would apply temporarily to all banks. Earlier, the finance minister said they could be in place for weeks. Banks have been shut since final bailout talks got under way in mid-March.

    Russia, whose citizens have billions of euros in Cyprus and use Cypriot banks to move money around even among Russian firms, cautioned Nicosia against imposing onerous controls on healthy banks and noted that Moscow was reviewing loan terms to Cyprus.

    "If there are such measures, this will not foster trust but only provoke additional problems for participants, depositors," Russian Finance Minister Anton Siluanov said on Tuesday.

    He cautioned that Russian willingness to restructure and extend a 2.5-billion euro loan made to Cyprus in 2011 would depend on the island's decision on capital controls.

    "We will discuss (restructuring of the loan) in the context of the decisions the parliament adopts," he said. "We are prepared to discuss within these parameters."

    State-controlled Russian bank VTB has a subsidiary in Cyprus, Russian Commercial Bank, which has not been directly affected by a bailout deal which focuses on big local banks that lost badly in the restructuring of debts in neighboring Greece.

    POPULAR ANGER

    The terms of the 10-billion euro ($13-billion) rescue from the European Union, International Monetary Fund and European Central Bank have stirred popular anger within Cyprus at the country's partners in the EU, notably Germany, the bloc's main paymaster and fiercest advocate of austerity.

    On Tuesday, many hundreds of high school students protested at parliament, in the first major expression of popular anger since the bailout was agreed in the early hours of Monday in Brussels. The deal largely side-stepped the Cypriot parliament, and has triggered opposition calls for a referendum.

    "They've just got rid of all our dreams," said one student, named Thomas.

    Outside the central bank on Tuesday, about 200 employees of the country's biggest commercial lender, the Bank of Cyprus, demanded the resignation of central bank governor Panicos Demetriades, chanting "Hands off Cyprus" and "Disgrace".

    Dimos Dimosthenous, a veteran Bank of Cyprus employee, said: "The bank is being driven to closure. That will be the end."

    A Bank of Cyprus official said its chief executive, Yiannis Kypri, had been removed on the orders of the central bank.

    It follows the appointment of a special administrator to run the bank, which is being restructured as part of the bailout deal, and an offer to resign by its chairman, Andreas Artemis.

    ACCOUNTS FROZEN

    The second largest lender, Cyprus Popular Bank, also known as Laiki, is to be shut down, and accounts of under 100,000 euros and some loans will be moved to the Bank of Cyprus. Deposits at both banks over the 100,000-euro mark, which is an EU benchmark for state insurance, will be frozen.

    Government officials have estimated that these larger depositors, many of them wealthy foreigners including Russians, could lose around 40 percent of their cash.

    On Wednesday, the government was appointing special crisis teams of economic experts to advise ministers.

    Many Cypriots say they do not feel reassured by the bailout deal, however, and are expected to besiege banks as soon as they reopen after a shutdown that began over a week ago.

    The long closure of the banks has hurt business, according to Andreas Hadjiadamou, president of the Cyprus Supermarkets Association, who said consumer confidence had "hit the floor".

    Maria Benaki, who runs a family silverware business on Nicosia's biggest shopping street, said she had not had a customer in days.

    "The situation is dire," she said. "What will happen at the end of the month when I need to pay my bills?"

    As in other areas, science and research are generating digital data faster and in larger volumes than ever before. The Deutsche Forschungsgemeinschaft (DFG, German Research Foundation) wants to help researchers in every discipline, from Assyriology to Zoology, to use data more effectively. The Joint Committee of Germany's largest research funding organisation has decided to launch a new funding programme. Its purpose is ensure that quality-assured research data, which is frequently collected at great financial expense in a time-consuming process, is secured on a more permanent basis and made available for re-use by researchers at a later date.

    According to current estimates, the global sea of data generated by our digital world doubles in size every two years. In Germany and in the rest of the world, this is giving rise to the question of how these huge flows of data in general, and research data in particular, should be dealt with. Against this background, the Alliance of Science Organisations in Germany formulated the "Principles for the Handling of Research Data" (2010), EU experts presented the paper "Riding the Wave" (2010) and the DFG approved the paper "Taking Digital Transformation to the Next Level" (2012). Furthermore, the German Council of Science and Humanities approved analyses and recommendations to develop information infrastructures in Germany (2012). In the view of all the organisations involved, a new way to manage research data should be given priority.

    The new funding programme is the DFG's practical response to discussions and recommendations. The objective of the new funding offered by the DFG is to institute and maintain helpful structures for research data that are oriented towards the demand and requirements of science. The programme will fund projects to develop sustainable concepts and solutions ranging from transregional data infrastructures for one or more disciplines to enhancements to existing infrastructure, taking account of international standards and cross-border cooperation.

    With the new funding line, the DFG is hoping that more disciplines will establish a structure that can be seen to encourage innovation. A crucial factor here is a change of awareness towards recognising the significance of quality-assured data management that will take steps towards the re-use of research data. The new funding programme is intended to make a contribution in this respect.

    Icahn opens door to Blackstone tie-up on Dell bid

    (Reuters) - Two of the most prominent U.S. investors could upset Michael Dell's $24.4 billion buyout bid for Dell Inc, after billionaire Carl Icahn opened the door to an alliance with Blackstone Group LP to wrest control of the computer maker from its founder.

    Icahn said on Monday he has started preliminary talks with Blackstone. Both sides have made bids that could be superior to the offer on the table from Michael Dell and private equity firm Silver Lake Partners LP.

    The backroom negotiations show how what started as a plan by Michael Dell and Silver Lake to take the PC maker private could turn into a months-long process.

    Icahn has proposed paying $15 per share for 58 percent of Dell. Blackstone has indicated it can pay more than $14.25 per share for the whole of the company, all in cash or partly in shares, leaving Dell as a publicly listed company. The Silver Lake-backed group offered $13.65 per share in cash to take Dell private.

    Dell, Silver Lake and Blackstone declined comment.

    Icahn, who owns a $1 billion stake in Dell, said both his and Blackstone's offers give the company's largest investors what they wanted most: the ability to retain publicly traded shares of Dell.

    Southeastern Asset Management, Dell's largest independent shareholder and one of the most vocal opponents of the Silver Lake plan, said it was pleased about that prospect, as well as the higher offers.

    Another investor, Bill Nygren, co-manager of the Oakmark Fund, added: "Given the wide range of estimated values for Dell shares, if all else is nearly equal, we believe a proposal is superior if it allows investors who want to remain invested in Dell the opportunity to do so."

    OPTION TO KEEP STAKES

    The value of Blackstone's and Icahn's offers depends on how much Dell shares would be worth following a buyout. However, Blackstone's offer trumps Silver Lake's outright because all shareholders can cash out, if they wish to, at a higher price.

    What is more, Blackstone's offer to Dell shareholders of the option to maintain stakes in the company and profit from any upside is likely to be viewed positively by the special committee set up to assess the offers, according to two people familiar with the matter.

    The outcome of the auction would determine the future of Dell, which was regarded as a model of innovation as recently as the early 2000s but has struggled to make up for declining market share in the global PC market.

    A source familiar with the matter said last week that Dell had slashed its internal forecast for fiscal 2013 operating profit to about $3 billion, down sharply from the $3.7 billion it had predicted previously.

    Dell's shares closed up 2.6 percent at $14.51 on Monday, indicating investors expect a deal to be done at a price higher than the Silver Lake bid. Earlier in the session they touched $14.64, the stock's highest level in 10 months.

    "We continue to believe a higher bid than the current $13.65 per share offer will likely be offered but, based on our assumptions, a $15 per share bid may be a threshold," Wells Fargo Securities analyst Maynard Um said in a note.

    "We believe a higher Silver Lake/Dell bid might still be a more attractive and strategic option, assuming information regarding the public stub and financial services sale is accurate," he said.

    Late on Sunday, two sources close to the matter said that the Silver Lake group had no plans yet to increase or amend its offer until Dell's special committee comes out with a ruling on the rival proposals.

    DOES MICHAEL DELL STAY?

    As part of his deal with the special committee of Dell's board that is running the auction process, Michael Dell has to explore the possibility of working with third parties on alternative offers. On Monday, Dell said he had reaffirmed that commitment.

    Still, Michael Dell is very concerned that Blackstone's offer would dismantle the PC maker he founded in 1984, two people close to Michael Dell said. The founder is worried that the buyout firm's plans would be inconsistent with his strategy to reinvest in the company, the sources said.

    Michael Dell is planning to meet with Blackstone to discuss the private equity firm's bid, two other sources familiar with the situation said.

    Blackstone made no mention of asset sales in its preliminary offer. But people familiar with the matter have told Reuters that Blackstone has considered a potential sale of Dell's financial services business as part of its turnaround plan.

    Michael Dell's role also remains unclear in a Blackstone-led deal. The buyout firm has already made an unsuccessful push to recruit Oracle Corp President Mark Hurd to run Dell if it takes over the company, one source familiar with the situation said last week.

    A number of issues remain to be addressed, a separate person familiar with the matter said on Monday of Michael Dell. Among them, what Michael Dell would do if a buyer wanted to sell a business and he did not, the source said.

    Potential buyers are likely to want to sit down with Michael Dell to discuss his plans for a privately held Dell Inc in more detail, the source said, adding that Blackstone had not done so yet.

    Switching bidding allegiances could preserve an affiliation with the company for Michael Dell, who founded the technology giant at the age of 19 with just $1,000.

    Under the Silver Lake deal, he planned to contribute his roughly 16 percent share of Dell's equity, along with cash from his investment firm MSD Capital, and remain CEO of the company. Silver Lake is putting up $1.4 billion.

    Christchurch Rebuild Jobs Scam Exposed | Stuff.co.nz

    A Christchurch businessman posing as a recruiter of Filipino workers has exposed the fees some pay to work in New Zealand.

    The businessman, who asked not to be named, has provided a recording he made of a licensed immigration adviser, explaining how he could "clip the ticket" on the fee paid by Filipino workers coming to Christchurch.

    Filipino workers are becoming a major part of the Christchurch rebuild and can pay up to $10,000, often borrowed at high interest rates, to pay for immigration processing, securing employment, and airfares. Many use the services of ANZSIIS Consulting Ltd, a licensed immigration agent based in Auckland and Manila.

    The businessman, who recruits and employs some Filipino workers, recorded a conversation with ANZSIIS director Rosemarie Scholes as he believed Filipino workers were being ripped off. Scholes, originally from the Philippines, was in Christchurch this month.

    In the recording, he asked Scholes how much he could get from the workers if they paid an upfront fee of $10,000.

    "We want to be clipping the ticket," he said.

    Scholes replied the company could expect about $3000 to $4000, "plus you are putting them in a place [accommodation] where they pay you", she said.

    She outlined how another Christchurch company (not named for legal reasons) was taking a cut of $2000 from the fee.

    Asked by the businessman how he could hide his cut, Scholes said the fee could be labelled as an "agency fee" and paid to a separate company. She would also charge the workers about $2000.

    "Any money handed over is between us. No matter what happens [you] will not get caught," she said, adding the system was lucrative enough for him to retire.

    "We're helping these people at the same time as they are paying us. It's a win-win situation," Scholes said.

    She named other Christchurch clients she dealt with, saying she was contracted to supply about 200 Filipino workers this year. She could also arrange loans for workers who could not afford the fees, with interest amounting to about $2000 on a loan of $10,000 over six months.

    Scholes, in a statement, said she believed the businessman was a recruitment agent and therefore entitled to a fee.

    "We were talking about a hypothetical situation and the recruitment fee was included in that as I believed they were looking for superior workers such as engineers.

    "I referred to them not being caught as there was nothing illegal about them charging a recruitment fee. It is up to them how they report it in terms of their overall income. I reiterate there would be no benefit to me in the increased fee and this is an unfortunate situation where I feel I have been misled and misrepresented over an issue that might relate more to concerns about direct employers than immigration consultants."

    The fees her company charged migrants are as follows:

    ANZSIIS fee $2019

    Philippines Overseas Employment Agency $1800

    Air ticket $1300

    Medical certification $300-$400

    Other documentation $200

    Marketing Agent NZ Dream $1300

    In other documentation she listed the fee charged by the New Zealand embassy for visa processing as $400 when the actual fee, according to Immigration NZ, is $270.

    The Philippines embassy in Wellington said the fee charged by the Philippines Overseas Employment Administration (not agency) was about $40, not the $1800 stated by ANZSIIS. Scholes said her POEA figure referred to the fee charged by private agencies and the documentation she provided was a draft agreement but she charged the correct fee on actual agreements.

    Scholes also founded the ANZSIIS (Australasia New Zealand Societal Intelligence and Immigration Services) International School. The company behind the school was put into liquidation by the High Court in Auckland last week on an application by Inland Revenue. She remains the only director and shareholder of ANZSIIS Consulting Ltd.
